Town board votes to re-establish second Town Justice, to appear on November ballot

The Town Board voted 4–0 to re-establish a second Town Justice position, adopting Resolution #22/2026. Town Attorney Kirk Gagnier explained that the re-establishment is subject to a permissive referendum with a 30-day petition period; absent a successful petition, the office will be placed on the November 2026 ballot for a four-year term effective Jan. 1, 2027.
Gagnier said pending village court dissolution, outstanding village cases will transfer to the Town Court and that both justices will have equal salaries as provided by New York State law. The board authorized the Town Clerk to file required paperwork for placing the position on the ballot and agreed that final salary numbers will be set during the 2027 budget process.
There was no recorded opposition; the motion passed 4–0 with Supervisor Rick Dattola absent.
