Zoning and Planning Commission members unanimously approved a 99-year special-use permit Oct. 2 to allow a Dairy Queen with drive-through facilities at 219 Ranch Road 620 South.
Staff briefed the commission that the site is designated commercial on the future land-use map and that the drive-through requires an SUP because the property is C-1 zoned. Staff noted the proposal uses a shared driveway with an existing O'Reilly's so it does not create an additional curb cut on Ranch Road 620. The applicant requested a 99-year SUP because it is constructing the building.
Applicant representative John Morgan (Lay Construction) and owner/franchisee Phil Tagmayer described the restaurant as a Texas Dairy Queen ("grill and chill") with roughly 65 percent of sales expected from food and the remainder from treats. The owner estimated approximately 550 vehicle trips per day, with the drive-through open until 11 p.m. Several nearby residents spoke during citizens' participation about existing congestion at the Flamingo/Pheasant intersection, u‑turns and the potential for additional traffic through residential access points.
Commissioners discussed traffic and the shared access; one commissioner noted that reusing an existing entry is preferable to creating a new cut. After brief discussion the commission approved the SUP by unanimous vote.
