Neoga council adopts ordinance enabling notice of reverter for development lots after debate over Lot 1

The Neoga City Council on Sept. 23 adopted Ordinance #1094, authorizing execution of a notice of exercise of possibility of reverter for the development lots covered by the measure.
During review, Commissioner Letizia questioned whether Lot 1, which already has a home started on it, should revert to the city as well. Commissioner Letizia asked, "if the Council should have Lot 1, which already has a home started on it, revert to the city as well." Mayor Helm responded that the city had concerns about potential liability if it took Lot 1 back: "there were concerns if the city took Lot 1 back, what liability there would be IF the property had any flaws." After discussion Commissioner Schabbing moved to approve the ordinance as presented and Commissioner Williams seconded; the vote was unanimous, 5-0.
The ordinance does not, in the council's final action, extend reverter language to Lot 1. Council members did not record any conditions or amendments formally adding Lot 1 to the reverter action during the vote. The ordinance is recorded as Ordinance #1094-0-2024 in the meeting minutes.
