After hours of legal debate, Rockford council elects Ald. Neal acting mayor

A special City Council session required aldermen to resolve how to fill the mayoral vacancy effective Aug. 30, 2026. Much of the session focused on interpreting 65 ILCS 5/3.1‑10‑50 (subsection f) and whether the statute’s plain language permits council election of an acting mayor when more than 28 months remain in a four‑year term. City legal staff explained their review and reported they consulted outside counsel; staff also noted the legislative history includes amendments that removed certain language in 2008. Director Hammer summarized the legal advice: "The memo does a good job of outlining the plain language in the statute," and staff said they were comfortable proceeding under statutory construction principles while acknowledging litigation risk.
After nominations, the council held a roll‑call election. The clerk recorded 6 votes for Alderman Neal and 4 votes for Alderman Tarina, with 3 members recorded as abstaining; Director Hammer explained abstentions do not count for the tally and that a majority of those voting is required for election. Following the result, Mayor McNamara congratulated Ald. Neal and offered to assist with the transition.
Council members urged the acting mayor to prioritize public safety, budget continuity and neighborhood quality of life during the interim period leading to the special election scheduled for April 7, 2027. Several members asked staff to consult legislative counsel in Springfield and to provide documentation supporting the legal position in case of a court challenge.
