The Selectboard took no action to adopt the proposed 2026 Land Use Ordinance after the Ordinance Committee recommended against adoption. Committee chair Mike Martin said the Committee discovered possible omissions in carry‑over provisions from the 2022 code, sections meant to implement Act 181 that may not reflect later amendments under Act 152, a lack of redline comparison to the 2022 code, and the absence of standard legislative drafting structure and section numbering.
The Committee recommended that the Board refer the draft to the Planning Commission with four specific requests: (1) confirm and explain how the draft implements Act 181 as amended by Act 152 (including tiered Act 250 jurisdiction), (2) review the Ordinance Committee’s recommended edits from its 5/6/26 report, (3) provide a redline or comparison showing how each relevant section of the 2022 code is changed or relocated, and (4) revise the draft to follow standard legislative drafting and codification practices. The Board voted 5‑0 to refer the document for the requested review and recommended continuing to use the 2022 ordinance until a properly-structured replacement is ready.
