"They wanted to pursue a special use permit, and that was not permissible as per our zoning regulations, as per legal counsel's advice," the commissioner said. The owner was sent multiple correspondences asking for a proposed date to cease operations. The owner’s husband met with officials and said he would discuss booking dates with his wife and the regional representative and return with an appropriate shutdown date.
Officials told the owner that any agreed shutdown date could not exceed August 1 and that, absent a written plan, July 1 will stand as the date to cease operations. The commissioner said that if the business does not provide an acceptable written schedule the city will pursue court action after July 1.
The zoning denial and enforcement timetable were presented as a regulatory compliance matter; commissioners asked staff to continue outreach and to document any commitments in writing.
