Fire access and easements shaped setback debate at Franklin BZA

A central theme during Item 2 at the Aug. 6 Franklin Board of Zoning Appeals meeting was how fire-department access rules and easements interact with zoning-setback standards. Staff cautioned that some aspects of the applicant's requested relief appeared larger than strictly required by zoning, while the applicant pointed to Appendix D and the fire marshal's guidance as operational constraints that shape building placement.
Staff told the board that "without the variance, they would be stuck in the site plan stage because right now, the requirement for the building along Riverside Drive is to be no closer no farther than 30 feet from Riverside Drive." Staff also said it could not justify the full 107-foot Riverside distance absent further analysis. The applicant, Greg Gamble, cited Appendix D and a fire-marshall requirement for a 26-foot fire-apparatus lane around a two-story, roughly 100,000-square-foot building: "Aerial fire apparatus access roads shall have a minimum unobstructed width of 26 feet," he said, and added the presence of overhead transmission lines constrained use of the right-of-way.
Board members and staff agreed that site-plan review and coordination with the fire marshal will be necessary to finalize exact access lanes, ladder zones and grading. The variance approvals allow conceptual building placement to proceed but do not substitute for the technical site-plan analysis that remains to be completed.
