Board approves 220-foot Oak Meadow Drive setback for 880 Oak Meadow Drive

The Franklin City Board of Zoning Appeals voted to approve a variance allowing a maximum front-yard setback of 220 feet from Oak Meadow Drive for the property at 880 Oak Meadow Drive. The board approved the request after staff and the applicant described existing stormwater infrastructure and access constraints along Oak Meadow Drive.
Staff told the board the frontage along Oak Meadow contains a large area of existing stormwater infrastructure that makes siting a building closer to the road impracticable; staff found criteria 1 and 2 for a variance were met for the Oak Meadow frontage. "In order to avoid the existing stormwater infrastructure and provide fire access around the building, the building cannot be located less than 30 feet from Oak Meadow Drive," staff said during the presentation. The board noted the stormwater system and existing road elevations as defining features supporting the hardship finding and voted to approve the Oak Meadow Drive variance by voice vote.
Applicant representative Greg Gamble said the requested setbacks respond to fixed on-site features and existing utilities, and that the request is not limited to a specific tenant. "This variance request...it really relates to any building that you put on here. It's not specific to Living Spaces," Gamble said, citing power-line easements and site slopes as limiting factors. Gamble and staff agreed site-plan review and fire-access details would be finalized later in the development review process.
The variance approval allows the owner to move forward in concept with building placement that accommodates existing stormwater facilities; site-plan approval remains subject to separate review.
