The Planning Commission recommended approval of Ordinance 2026-09 on April 15, a code amendment intended to clarify what counts as "ordinary maintenance and repair" for noncomplying buildings and to add rules addressing involuntary removal where structures have declined over time.
Under the proposed text, ordinary maintenance and repair is allowed when it does not expand existing nonconformities or create new ones and may include interior improvements that do not create additional habitable space. The new involuntary-removal section would allow reconstruction of building elements above the slab (for example, exterior walls or roof trusses) if an engineer or suitably qualified professional provides a written opinion that extensive work is necessary to make the building safe and sanitary. Planning Commission approval would be required before demolition in such cases; approval would not be granted retroactively after demolition.
Commissioners said the revised language addressed ambiguities the Council had asked the commission to clarify and agreed the draft provided reasonable standards for handling structures that have fallen into disrepair but did not result from a catastrophic event. The commission moved to recommend the council adopt the amendment; the motion passed unanimously (Kruschke: Aye; McCulloch: Aye; Zimmerman: Aye).
The commission recorded findings that the amendment clarifies requirements for maintenance, repair, alteration and improvements to noncomplying buildings and establishes conditions for limited reconstruction when necessary for safety.
