Council tables Port Grande Estates Phase 2 final plat amid bond and agreement timing concerns

City staff told council the developer’s June 6 performance bond referenced a contract that did not exist at the time the bond was signed and that the language did not provide the city sufficient financial assurance. A development agreement intended to address the issue arrived late on the Friday before the meeting and therefore was not legally before the council under the Texas Open Meetings Act 72-hour posting requirement.
"So as of right now, based on the information I have, I could not recommend approval of the plat at this point because of those issues," a staff member told the council. Members discussed options including denial, approval with conditions, or tabling; the council voted to table the final plat to the July 8 meeting to allow the developer to correct bond language and submit any development agreement in compliance with posting requirements.
