County attorney: Court of Appeals reverses and remands two cases involving county zoning and litigation

County Attorney Bin Minter told the board the Court of Appeals recently reversed a Superior Court ruling in UGOCCC v. Damon Hoyte, reinstating magistrate-court rulings, and separately reversed the Superior Court in Melissa Haymond v. Hoyte, vacating denial of a motion to dismiss and remanding that matter.
County Attorney Bin Minter briefed the Board of Commissioners on two recent Court of Appeals decisions affecting county litigation. He said the court “issued its opinion reversing the decision and reinstating the original decision and prior rulings of the magistrate court” in UGOCCC v. Damon Hoyte (Superior Court Case 23CV072), a case that originated from a 2022 zoning violation and subsequent appeals. Minter stated the county’s prior order requiring refund of fines to Mr. Hoyte was reversed, restoring the earlier magistrate ruling.
Minter also described a separate appeal in Melissa Haymond v. Hoyte, in which the Court of Appeals reversed the Superior Court’s denial of a motion to dismiss and remanded the case to Superior Court for further proceedings. He said motions remain pending in Superior Court. The attorney framed both items as procedural developments; no votes were taken during the meeting on either matter.
