North Henderson adopts nuisance ordinance to pursue court action on burned property

The Village of North Henderson Board of Trustees adopted a nuisance ordinance April 22 that officials said will allow the village to pursue court action related to a burned property.
Clerk Melody Hall told trustees the village attorney has tried to contact the property owner without success and "the lawyer now wants to take the matter into court but the village does not have an ordinance in which the property would fall under." Hall said a nuisance ordinance is the quickest mechanism to bring the matter within the courts' authority.
Trustee Diane Brown moved to accept the nuisance ordinance; Trustee Cheryl Stevens seconded. The board recorded a roll-call vote with Trustees Diane Brown, Karin Simkins and Cheryl Stevens voting aye. Trustees Angie Chandlee and Christian Spahr were absent. Clerk Hall said the ordinance was intended to cover a range of nuisances so the court could address the burned site.
With the ordinance adopted, the village attorney may proceed with the next legal steps. The board did not provide a timeline for court filing during the meeting.
