Board approves 437 Briar Way build permit with roadway and utility conditions

The Borough of Beachwood Land Use Board approved the variance application for 437 Briar Way (Block 1.25 Lot 3) on July 13, 2026, imposing conditions requiring roadway and utility improvements before construction permits are issued.
Applicant David Lipton sought bulk variances and design waivers to permit the construction of a single-family home on a previously wooded nonconforming lot. Stuart Challoner, the applicant's engineer and planner, testified the proposal included improving Briar Way to a 22-foot-wide roadway, installing a fire hydrant at Bowline Street and Briar Way, and placing a blowoff hydrant at the end of the improved roadway. Challoner also agreed during the hearing to extend pavement to the guard rail and add drywells. Board Engineer Ryan MacNeill requested revised roadway and stormwater plans for review.
Resident Ronald Perez (448 Leeward Avenue) raised concerns about the narrow entrance to Briar Way, access for emergency and sanitation vehicles, and emergency access to the adjacent woods. During public comment the applicant noted legal limits on reliance upon lay testimony without expert evidence. Fire Official Rich Foster told the Board he had not received revised plans and advised that the proposed 'No Parking' signs would not be enforceable without a Borough ordinance change. The Board recorded conditions of approval that require: completion of roadway improvements (pavement to guard rail, drywells), extension of the water main, installation of a fire hydrant at Bowline Street and Briar Way, installation of a blowoff hydrant at the end of the roadway, placement of 'No Parking' signs (subject to a Governing Body ordinance), recording the Resolution with the Ocean County Clerk together with the deed, and a limitation of the dwelling to one-and-one-half stories. The application passed on a 4–3 roll-call vote.
