Staff advised that any court approval should be conditioned on final engineering plans, demonstrated drainage mitigation and showing how the proposed road ties into existing county roads and rights‑of‑way. The court approved item 47 with contingencies referenced in a July 30, 2026, review letter and directed applicants to return with final stationing and drainage details where required. For at least one variance (ditch slope) the court moved to deny but allowed the applicant the ability to return after engineering adjustments.
Commissioners emphasized protecting adjoining property rights, preserving emergency access, and ensuring drainage does not increase runoff to downstream properties. The planning department will require revised plans reflecting the final design and will verify compliance before final plat recording.
