Health Director (addressing the board) said, “We were looking just for the board to vote to delegate the authority to respond to the open meeting law complaint within the 14 day period to our town council, Tom Mullen.” A committee member moved to refer the complaint to town counsel and another member seconded. The board approved the referral by voice vote.
Board members discussed that, should the town counsel need further clarification, counsel would contact town staff (Candace) and then report back to the board. One member noted that delegating the response to town counsel has worked well in past cases; the board did not direct additional fact-finding at this meeting.
The action was recorded as a formal referral; the board instructed counsel to handle the official response and to notify the board of any findings.
