Board adopts revised bodywork regulations; effective date set for Aug. 24
Summary

The Tyngsborough Board of Health voted Aug. 10 to adopt an amended set of bodywork regulations and set an effective date of Aug. 24, 2026. The motion to accept the regulations was made, seconded and carried with recorded votes in favor.
During a lengthy, page-by-page review board members and legal counsel recommended stronger mandatory language for prohibitions (replacing discretionary terms such as "may" or "at no time can" with clear statements such as "must not"), clarified required identification (two forms of ID with one containing a photo, and a passport-style 2x2 photo for permit records), and discussed background-check procedures. The board agreed it will require criminal-history checks from applicants, including checks of jurisdictions where the applicant resided in the previous ten years, and to retain discretion to evaluate convictions reported within a specified recent timeframe.
Members discussed minimum liability insurance and training standards; the consensus was that a $1,000,000 aggregate liability policy is sufficient for the regulation. The board also adopted language requiring CPR training from a nationally accredited organization and kept the TB-testing requirement in place for the time being while directing staff to confirm applicable Department of Public Health guidance.
The board adopted enforcement provisions that permit summary suspension of a permit in emergent circumstances, with subsequent opportunity to appeal at a hearing. Carrie Umf and staff will prepare the statutory summary for publication and send certified regulations to the town clerk; staff also agreed to notify currently operating establishments about the requirement to apply under the new regulations.
Votes and implementation: the motion to accept the amended regulations and set Aug. 24 as the effective date carried by recorded board votes. Staff will publish the required summary in a newspaper of general circulation and file the regulations with the town clerk and state as necessary.
