Neighbor presses Nederland to pause Helena construction over lot‑width and drainage concerns

Darryl Montgomery told council the Montgomery family had requested to be on the agenda to raise concerns about two homes under construction at 1314 and 1318 Helena. He said the lots were split below the minimum 50‑foot requirement (measured at about 49.77 feet) and that the developer’s file lacked critical documentation such as elevations, stormwater and utility plans.
Montgomery described alleged drainage and elevation problems he said are already affecting his parents’ house, saying "everything is flowing right now from their property onto my parent's property" and that water has been observed entering under the neighboring house. He asked the council to stop work until a variance request is resolved and until the city assembles a review team to evaluate compliance with Section 26 of the Nederland zoning code.
City staff and the city attorney advised the council to consult in executive session. Council moved to enter executive session to consult with the city attorney; that motion passed on roll call, and the meeting recessed. After the executive session the city attorney said he would research the legal issues and report back to the council; no formal action or stop‑work order was issued that night.
Montgomery urged expedited review because lumber was delivered and walls were scheduled to be erected; staff told him follow‑up would appear on a future agenda and that notices are posted on the city agenda and outside City Hall.
