Planning commission approves Highland Estates final plat, development agreement

The Pleasant Prairie Planning Commission voted to approve the final plat, development agreement and an interim grading agreement for Highland Estates, a phase that creates 90 single-family lots and two outlots. The motion, moved by Neil and seconded by Terry, passed on a voice vote.
Rob (staff member) told commissioners that, under the memorandum of understanding and development agreement, "at the time of a new building permit issuance that a transportation improvement fee of 12, $112.50 per unit, is paid, to the village." He said those funds will be held separately for future roadway improvements associated with Highway 165 and related work.
The agreement also requires the developer to maintain construction access between Lots 94 and 95 until the village completes planned work on 93rd Street. Staff said an interim grading agreement will be executed before the final plat is recorded so limited grading activity can begin while the overall development agreement is finalized.
Phase 2 will be incorporated into the existing declarations from Phase 1 via a supplemental declaration of restrictions and covenants; staff noted accessory-building specifications, monotony requirements and homeowners-association maintenance obligations will be carried forward. Lots 113 through 117 on 51st Court will be included in the Devonshire Homeowners Association as previously agreed.
The commission approved the package after the chair noted prior public review and professional due diligence. No public speakers addressed this item during the hearing.
