Borough Engineer Steve Cosaboon reported during old business that application #25-LUB-010 (Proctor Properties II, LLC), a proposed change of use at 717–719 N. Delaware Street, was required to include a professional survey. The survey submitted to the board included an additional lot that was not listed on the original application; Cosaboon recommended the applicant submit a new application to account for the extra lot.
The applicant's attorney requested that the requirement be "waived" in a response to the Board Secretary. Solicitor John Alice said the board could deny the application for incompleteness but that he would reach out to the applicant's attorney to resolve whether the matter can proceed or if a new application is required. No formal action was taken at the Dec. 2 meeting; the matter remains open pending clarification or resubmission.
