The Board of Water Commissioners reviewed license documents for a 4 Grove Street encroachment after Mark Warren said Westford Town Counsel had reviewed both the License Agreement and the Assignment and Assumption of License Agreement.
Commissioner Chauncy Chu asked for clarification on maintenance responsibilities, license registration, insurance, indemnification and termination provisions and flagged the wording in section 11. The board agreed to remove the word "but" from section 11. It was moved by Titus Palmer, seconded by Chauncy Chu, and approved unanimously (3-0-0) to accept the License Agreement documents pending removal of that word.
A subsequent motion by Commissioner Chu to require that all License Agreement documents be recorded with the Registry of Deeds was defeated (2-1-0); Maguire and Palmer opposed and Chu voted yes. The board did not direct further changes beyond the agreed wording revision.
