City Planner Ursula Brandt told the Planning Commission that the applicant for 81 38th Ave NE seeks variances to allow a 0‑foot parking‑lot setback on multiple property lines so the owner can construct a five‑space lot (including one accessible space) to serve an office and warehousing use.
Brandt summarized the zoning and parking calculations, saying the Code requires one parking space per 300 square feet of office and one space per 3,000 square feet of warehouse; the building’s mix (1,500 sqft office; 4,500 sqft warehouse) requires seven spaces but currently uses about 11 legal nonconforming stalls along the south side of the building. The applicant previously received a similar variance in 2012 (Resolution 2012‑050); Brandt noted a 1990s vacation of California Street right‑of‑way added land to the parcel and that buried utilities were reviewed and found compatible with construction.
Commissioners asked about adjacent railroad/right‑of‑way, developability of the land to the west and environmental review; staff said the west area is city‑owned green space and the City does not require an environmental study for paving. After no public comments, the commission voted to recommend City Council approval of Resolution No. 2026‑043 to allow the 0‑ft parking setback.
