Vice Chair Jonathan Scheuer told the Board that discussions between Maui County and the Public Sector Pension Fund doing business as Mahi Pono have continued regarding whether a mutual agreement over long-term disposition of East Maui irrigation assets is possible. Scheuer said the 2026 revocable permit requires monthly stakeholder meetings that are open to the public.
On litigation, Member John Helly asked how a recent Environmental Court hearing and a requested contested case would affect the pending disposition. Scheuer said counsel represents the board in ongoing litigation and that the contested-case request was filed by the Sierra Club over the 2026 revocable permit. He said "a ruling may be coming down on that," and also noted a planned Board of Land and Natural Resources meeting on Maui to discuss long-term East Maui disposition had been postponed.
