Planning board tables review of neighbor's jet-ski lift after residents raise riparian-rights concern

Jeanie and Bryan Brockmyre, residents of 7415 Phelps Avenue, told the Town of Huron Planning Board on Sept. 3 that a permanent-style jet-ski lift recently installed at the neighboring dock at 7421 Phelps Avenue has altered their waterfront view and was permitted after the installation.
"The installation of the lifts has impacted their view," the Brockmyres told the board, and said they would have raised formal objections had the permit application come before the zoning body. Planning Board member Deb Stuck asked whether any poles cross property lines; Bryan Brockmyre said he believes one pole could sit on his land.
Staff member Roger Gallant advised the board that questions about riparian lines and ownership typically require a certified survey and, if disputed, a judicial determination. "It would need to go in front of a judge to certify the survey map," Gallant said, describing the legal route for resolving waterfront boundary disputes.
Chairman Alexandra Welsh moved to table consideration of the lift until the next monthly meeting so all board members can view the installation and the board can clarify permitting and boundary questions. The board did not take a final action on the installation at this meeting; the item will return to the agenda next month for further review.
