Applicant attorney Jacob Pierkowski defended the plan as a destination retail concept, telling the board that “In fact, the 4 closest stores don't offer single barrel bourbons,” and said the proposed business would fill a niche. Nearby retailers and a written opposition argued single‑barrel bourbons are already available in the market and that the region is overserved. Board members examined sales numbers for nearby stores and the applicant’s exhibits before reaching a vote.
Commissioners said the 80% commitment distinguishes the applicant from neighboring stores; licensing staff will audit inventory when needed and may revoke the license if the condition is not honored. Commissioner John Maia and others noted political support in the locality but emphasized enforcement: “We will check. And if you're not doing 80% bourbon, we're going to come back here, and we're going to cancel it,” a commissioner said during the hearing.
The board recorded approval votes and noted that monitoring will include checks of shelf mix and sales reports. The licensee accepted the 80% restriction as a condition of approval.
