Marlborough board reintroduces local law to clarify public-records procedures; hearing set for April 27

The Town Board reintroduced a revised local law on April 13 that would amend the Town Code sections governing public access to records (Sec. 41-4, 41-5, 41-8 and 67-13) and set a public hearing for April 27, 2026 at 7:00 p.m. at Town Hall. The resolution offers the full revised text and directs that notice be published in the town’s official newspaper.

The draft clarifies procedural points: written requests will be accepted at the Town Clerk’s office during regular business hours and by email; the Clerk is afforded five business days from receipt to respond under Public Officers Law §89(3); if disclosure cannot be completed within 20 business days the Clerk must explain the reason and provide a new date certain. The draft also addresses inspection appointments, reproduction formats, and fees: inspection and searches would not be charged a fee, photocopies are set at $0.25 per page, and other reproduction fees are capped at actual reproduction cost. The text in the minutes notes that, "Immediate production of requested records is not required and the Clerk is afforded five (5) business days from the date of receipt of the written request to respond pursuant to Public Officers Law §89(3)."
