Zoning board OKs homeowner’s deck replacement in 75-foot wetland buffer

The Zoning Board of Adjustment on Aug. 11 approved a special exception that will let Kathleen Yurell Wallace replace an existing deck at 12 Britton Drive that lies in a 75-foot prime wetland buffer.
Wallace told the board the deck has been in place for more than 25 years and that she needs to replace rotted boards and bring footing depths up to current code; she said the existing structure is effectively a 12-by-24 deck and the new construction will use the same footprint. The board noted a July memo from the Conservation Commission recommending approval with no additional stipulations.
During deliberations board member J. P. Boucher said the request was reasonable because many houses on that side of the street already have structures within the buffer and rebuilding for safety was appropriate. The board moved, seconded and approved the special exception; the chair reminded the applicant there is a 30-day window to appeal.
The decision allows the homeowner to proceed with permitting and construction, subject to the normal building-permit and conservation-process reviews. The board recorded the requirement that footing depth be updated to current code as part of the work.
