Lincoln County planning commission backs amended data-center rules after lengthy public hearing

The Lincoln County Planning Commission voted to recommend adoption of AM26-004 — amendments to section 8.22 of the county zoning regulations governing data centers — after an extended public hearing in which residents pressed for stronger monitoring, reporting and enforceable protections for water, wildlife and emergency response.

Commission staff summarized the regulatory process and said a subcommittee and outreach had produced a first draft. Residents and experts urged measurable standards. "You cannot protect what you don't measure," said Mitch Josten, a North Platte resident urging an environmental-monitoring definition tied to specific parameters such as water use, lighting and noise. Greg Mooney asked the commission to consolidate multiple reporting obligations into a single section with annual and immediate-event reporting and a January 31 deadline for annual submissions.

Commission discussion focused on balancing detailed, legally defensible requirements with the risk that overly prescriptive rules could be thrown out in court. Planning staff and legal counsel described conditional-use permits and environmental studies as tools to evaluate projects on a case-by-case basis while also noting community benefit agreements could be required before final conditional-use approval. The commission approved a motion to recommend AM26-004 as amended and said staff would reword the agreed amendments before forwarding them to the Board of Commissioners.
