Council approves Thomas Earl commercial site plan after member recuses

Council considered the Thomas Earl Commercial Final Engineering Site Plan for a 1.027± acre site at the southeast corner of Milrany Lane and Thomas Earl Way.
Preston Taylor recused himself and left the meeting prior to the presentation. Tyra LaVerne reported staff review found the plan complies with applicable Code and zoning except for a requested variance: the project's refuse enclosure would be approximately 50 feet from a residential district boundary, while City Code requires refuse enclosures to be located at least 100 feet from residential district boundaries. LaVerne said the applicant proposed enhanced screening and landscaping to mitigate impacts. The Planning and Zoning Commission had recommended denial by a 6–1 vote.
After discussion, Council approved the Final Engineering Site Plan by a 5–0 vote. The motion was made by Craig Ackerman and seconded by Joseph Armstrong. Taylor rejoined the meeting shortly after the action.
