Lorain County journals expedited annexation petition for 65.26 acres to Elyria; decision set for Aug. 25

The Lorain County Board of Commissioners on July 28 received and journalized a Type 2 expedited annexation petition to transfer roughly 65.2559 acres from Amherst Township into the City of Elyria.

Attorney Jon D. Clark appeared as agent for the petitioner Builders & Developers Co., Inc., and the petition (Res. No. 26‑423) included Exhibits A–D: a full legal description, a survey map and lists of owners and abutting properties. The board recorded the journal entry and directed the county auditor and county engineer to review the petition for accuracy before the matter returns to the commissioners. The board scheduled a decision on the proposed annexation for August 25, 2026 — the 34th day after filing — provided the statutory municipal actions (resolutions about services and zoning) occur within the required timeframes.

Commissioner David J. Moore reported he had received calls from Amherst Township trustees and urged Elyria to contact trustees to negotiate concerns, noting the trustees reported the city and township had different anticipated housing counts for the property (trustees reported 130; he said the city indicated up to 200). "If the city is not returning phone calls and not working with them it will make it very difficult for me to vote for this issue on the 25th of August," Moore said.

Commissioner Jeff Riddell reiterated the board's neutral, ministerial role in Type 2 annexations: the commission's duty is to ensure the petition follows statutory steps and documentation, not to substitute its policy judgment for the property owner or the receiving municipality's ordinances. He said the board's function is to "audit the process and make sure ... the party has the right paperwork and takes the right steps."

The petition lists Builders & Developers Co., Inc. (owner: Richard Beran) as the petitioner and includes a detailed metes-and-bounds survey prepared by R.M. Kole & Associates with a survey date of June 25, 2026. The board adopted Res. No. 26‑423 unanimously and will consider the annexation on August 25 if the municipality and township file the required ordinances and consents within statutorily prescribed intervals.
