Mister Novak, the staff presenter, told the board that “maximum occupancy shall be set at 49 persons” and that “the BZA grants authority to the staff to increase the maximum occupancy to 90 persons per the 30 off-street parking spaces upon confirmation that the 2nd ADA code compliant ramp is constructed at the rear exit” (staff recommendation). Petitioner Raul Correa confirmed to the board that he would construct the required rear ADA ramp when asked: “Yes.” The motion to approve the staff findings and forward the petition carried on a roll call of 3 ayes, 0 nays.
