The developer’s representative (identified as Baker) described the final plat as roughly 14 acres to be divided into fourteen 1-acre tracts and said a minimum elevation had been added for the two front lots to address backwater flooding from the Leona River. During questioning, a commissioner raised a regulatory concern, saying "there was a senate bill that was passed and ratified in the legislature couple years ago that required a hydrologist to do a study on the availability of of water." The commissioner urged that the court verify whether that statute applies before approving the plat.
After discussion about local ordinances, hydrology, and review by county staff, a motion to table the final plat for further legal and engineering review carried 3–1. Commissioners noted the county will check applicable state law and have county counsel or appropriate reviewers confirm compliance before returning the item for a final vote.
