A substantial portion of the Dec. 23 meeting was devoted to a technical and legal discussion about water intrusion at the newly installed Community Park pavilion restroom slab. Staff described the slab as one continuous flat pour that causes water to flow back toward the building and seep through control joints into restrooms and the utility room. "The construction as is right now isn't acceptable," staff said during the discussion.
Trustees, staff and counsel discussed repair options including interior work to ensure floors drain to floor drains, saw-cutting around the slab and installing flashing, installing a trench drain around the building, or a complete slab replacement. An attorney on the record summarized the legal framework: whether the contractor will bear the expense depends on whether they deviated from the design, and disagreements between parties are common. "If they deviated from the design in such a way that has led to some of these problems, they will ... ultimately be their expense," counsel said.
Board members asked whether the contractor had been given a chance to propose a fix; staff said the contractor is aware of the problem but a firm remediation plan has not been agreed. Trustees emphasized a preference for a durable, long-term solution rather than a short-term patch, and asked staff to get the contractor's proposed fixes and the village attorney's view on whether a full replacement can be recovered from the contractor if the work passed an initial inspection.
