Huachuca City instructs attorney to draft firearms code changes to match state law

Town Attorney Thomas Benavidez identified specific Town Code provisions for amendment, including Section 18.100.210(D)(1) (Weapons Merchant Prohibited Home-Based Business Use), Section 9.20 (Minors Prohibited From Carrying Firearms) and Section 2.55.070 (Fees Chargeable By Police Before Firearms Transfer). He told the council the town “currently prohibit[s] things which the state does not,” and requested authorization to prepare the ordinances so local law aligns with state requirements. The attorney also referenced statutory timelines for upcoming elections in the course of the discussion (ARS §16-120, §16-134, §16-542(C)).
Mayor Johann Wallace moved to authorize preparation of the firearms-related ordinances; Cynthia Butterworth seconded the motion and council approved it unanimously. The minutes record the authorization to draft but do not show finalized ordinance text, a public hearing date, or an adoption schedule. The town attorney will prepare draft ordinances for future council consideration.
