Board splits on timing: sign contract now or wait for member‑agency budget approvals

Some directors, citing price volatility in pipe and labor, urged immediate authorization so the contractor could order materials and preserve current pricing. “The sooner that the contractor can sign agreements, the better the cost will be,” a board member said during remarks urging prompt action.
Other directors, citing legal counsel and the JPA, warned that expenditures above budgeted amounts require either unanimous board approval or documented midyear budget amendments by member agencies. Jeremy, SAM counsel, advised there are drafting approaches that allow the board to authorize the contract while protecting SAM from committing funds that have not been formally approved by the member agencies.
The board compromised by authorizing the general manager to distribute budget amendment materials and permitting contract execution only after each member agency communicates in writing that it has or will fund the Option 2 scope. The motion passed after roll call, balancing urgency and fiscal governance.
