Council outlines rules for small wind turbines; attorney: 'I haven't seen any' state regs for micro Tier III

The Lafayette City Council discussed a proposed wind turbine ordinance for small ('micro' Tier III) turbines and reached several policy decisions: no permitting in residential zones, a fall-radius setback of 1.5 times the proposed turbine height in agricultural zones, and a requirement that all wind turbine permits be processed as conditional use permits (CUP).
When Councilor Tom Polich asked whether any state regulations cover micro Tier III turbines, City Attorney Aaron Walton said he "hasn't seen any" such state requirements. The council asked Walton to draft the ordinance with those local controls reflected, including the CUP approach to permit review and the 1.5-times fall-radius standard in agricultural areas.
