ZBA issues multiple decisions, including legalization of several preexisting structures with conditions

At the close of the Aug. 6 meeting the ZBA read and voted on multiple decisions: it granted a series of variances to legalize preexisting accessory structures and minor conversions (including a pickleball conversion, pool location, sports courts, pyramid reliefs and other items), often subject to conditions (revegetation, removal on change of ownership, maintenance obligations).

The Zoning Board issued a batch of written decisions at the Aug. 6 meeting covering a range of applications. Several grants legalized previously built accessory structures or minor conversions, on the record and often with conditions addressing mitigation, revegetation, or removal if ownership changes.
Examples read into the record included authorization to legalize a conversion of a tennis court to a pickleball court at 38 Fox Hollow Drive and to legalize a pool at 58 Hampton (each decision noted the board's reluctance to condone unpermitted construction but found statutory standards met). The grants contain conditions: revegetation amendments where planning review is needed; notation on building department certificates; restrictions (for example, a sports court granted relief that may not be used for pickleball); and removal requirements within six months of a change of ownership in some cases. Each motion was moved, seconded and carried with recorded ayes by sitting members.
