"So if I wanna construct a sidewalk that's not in compliance with this article, I can proceed without the city's permission," Marty said, citing language in the draft. He also said the ordinance allows the city to reimburse "up to 50%" of construction costs but includes multiple discretionary provisions that could reduce or eliminate that reimbursement, leaving homeowners with large bills.
Marty asked the council to clarify whether nonreimbursed projects must still meet Illinois Department of Transportation (IDOT) standards, noting a section of the contract with a construction-observation firm, Tealion, was left blank and questioned what the city would get for a $27,000 line item. "I can't find a quote from Tealion," he said, asking the council to share the contract or documentation that defines the scope of that work.
The council acknowledged the concerns during discussion but did not adopt immediate changes to the ordinance in the meeting. The item remains on the council's agenda for future committee review; no formal amendment or vote on the ordinance text was recorded in this session.
