The Salem Township Planning Commission on Sept. 4 recommended approval of Penn Home & Farm LLC’s request to add Lot 1 as additional side yard to the Kilpatrick property (Tax Map No. 57-12-00-0-021), subject to detailed technical and documentation conditions.
Tom Spears, identified in the record as the property owner and sole owner of Penn Home & Farm LLC, presented the application. Resident Ken Brozack raised a question about whether a right-of-way exists to access the rear parcel. Township Solicitor Gary Falatovich responded that the Garden Courts Plan of Lots from the 1960s referenced two proposed 50-foot streets that were never dedicated or opened and that the recorded plan contains no reserved easement to reach the back parcels. According to the commission record, Penn Home & Farm LLC also owns parcel 57-12-00-0-032 and will use that parcel to access 57-12-00-0-021.
The commission’s approval recommendation is conditional. Staff and the solicitor listed a set of required changes the plan must show or provide before final endorsement: a signed Non-Buildable Waiver (already submitted), SEO/Township/DEP approvals, front and side/rear building setback lines (30 feet front from Mark Drive; 10 feet side/rear), labeling of the driveway, the right-of-way width and identification number for Mark Drive, pre- and post-subdivision acreages, identification of any sanitary sewer easements affecting the property, and a plan note stating, "Penn Home and Farm owns 54 Mark Drive, Tax Map Parcel No. 57-12-00-0-032, access to Tax Map Parcel No. 57-12-00-0-021 from Mark Drive is available through that property." The commission also required documentation from the Pennsylvania Department of State confirming Penn Home & Farm LLC’s registered address, copies of documents identifying the LLC’s members, an Owner’s Certification that names the representative as the "Sole Member," and signatures from John J. Kilpatrick and Patricia G. Kilpatrick on the plan. A revision number and date must appear on the final plan.
On a motion by Planning Commission member Paul Holleran, seconded by Chair Connie Mattei, the commission voted unanimously to recommend approval subject to the conditions listed by staff and the solicitor.
