Hellertown Borough Council moved on Jan. 20 to table a proposed site agreement with Greenlight Energy after members said several contract terms need clarification. A council member who moved to table the item said the council wants answers on easement language, insurance coverage, jurisdiction for any litigation and whether generators or air-conditioning referenced in Greenlight’s presentation are the contractor’s responsibility or the borough’s.
The council’s decision followed public questions and staff review. Staff said they would check insurance details with Greenlight and whether an easement could be limited to the term of a lease rather than remain perpetual. “I would like to make a motion to table it until we get the everything worked out, answered, and agreed upon,” the council member said before the motion carried. The item will return after the borough receives written clarifications and proposed contract edits.
