Board approves rule changes to align FOIA appeals with statute

A staff presenter told the board the packet includes amendments to section 15.51 and described two categories of changes: timing corrections to match statute (changing a response requirement from seven business days to five) and a substantive removal of an internal-appeal process for FOIA denials. "The FOIA statute requires appeals to be filed with the Attorney General's public access counselor or" the transcript records, the presenter said, urging the board not to accept internal appeals.
The board moved, seconded and approved filing the rules and seeking adoption before the Joint Committee on Administrative Rules (JCAR). The vote was recorded by roll call with all members present voting yes.
