General Counsel Marnie told the board that, for agenda item 2a8, the committee's records and bank statements showed a Reyes Coca Cola Bottling LLC contribution was disclosed two days late rather than six. She recommended modifying the hearing officer's recommendation to reduce the fine rather than deny the appeal in that portion.
"The committee has demonstrated that its contribution from Reyes Coca Cola Bottling LLC was disclosed 2 days late rather than 6 days late, via some bank statements provided," Marnie said. The general counsel recommended granting the PepsiCo portion of the appeal and reducing (but not eliminating) the Reyes Coca Cola-related penalty.
A motion to accept the general counsel's modified recommendation was made and passed on roll call. The board's action changes the original hearing-officer disposition for the Reyes Coca Cola disclosure and results in a penalty reduction recorded on the public record.
