Councilors then discussed the three finalists. Multiple members said their decision weighed risk, community fit and affordability. One councilor who identified as Sam said he believed "the least risky would be 5 20 Grill," pointing to the applicant's established presence, catering ability and local ties. Other councilors echoed concerns about menu price points and alcohol licensing, noting that a beer-and-wine option could preserve family orientation without making the space a "dive bar." The council indicated a preference for 5 20 Grill and directed the city manager to enter contract negotiations with that applicant.
Staff clarified the process: negotiations will be led by city staff, and any final lease agreement will return to council for approval. Because the city will discuss negotiation strategy and property/lease terms, staff requested an executive session under Colorado statute; council voted to enter executive session and staff cited Colorado Revised Statute section 24-6-402 (subsections related to acquisition/lease and negotiation strategy) and noted a pending water-court case (2025CW3177) for which the city has filed a statement of opposition.
