The Landmarks Preservation Commission approved a legalization request for rear‑facade work at 42 West 70th Street, concluding that the completed reconstruction is not visible from a public thoroughfare and that the work did not remove any significant architectural features. Staff described that top‑floor windows installed during reconstruction were slightly shorter and installed a few inches higher than originally approved, and that a metal spandrel was introduced between third‑ and fourth‑floor windows for structural reasons.
Roberto Shiliberto of LPC staff said the changes resulted from construction documents and a measurement error and that the reconstructed façade largely matches the approved intent. Megan Fitzpatrick of Landmark West urged the commission to require the originally approved details be restored, but commissioners ultimately concluded the differences were minor and approved the as‑built condition.
