The State Board voted to raise the low-dollar threshold that governs certain settlement and enforcement considerations from a $5,000 recommendation in staff memo to $10,000 after board members said small committees lack resources for sophisticated electronic filing.
Tom Newman, director of disclosure, presented the staff memo and said he had recommended $5,000 as a sensible baseline, but multiple board members moved to set the level at $10,000 to better reflect committees’ capacities. One board member argued, “These small committees really don't have some of the high-tech resources available to them,” and urged raising the threshold.
Board members asked whether the change would take effect immediately for pending settlement offers. Newman said, “My intention would be it goes into effect immediately. So with any settlement offers that we have already received and have not been brought to the board, we will view those with the $10,000 level for low dollar.” The board voted to approve the change by roll call.
The board also directed staff to post notice of the new threshold on the agency website and to incorporate it into rule amendments under consideration; staff agreed to consult IT about implementing public notice and administrative updates.
