Council introduces $2.4M sewer bond and advances Livingston Mall redevelopment plan with eminent domain reference

Clerk read Ordinance 29-2026, a $2,400,000 bond ordinance for the sewer utility system, and the council moved it to first reading with a public hearing scheduled for Monday, Sept. 14. The measure was advanced on roll call for first reading.
Clerk also read Ordinance 30-2026, an amendment to the Livingston Mall redevelopment plan (Block 6002 Lots 1 and 1.01). Barry (Town staff) told the council the amendment simply adds a reference to the right of condemnation so the mayor and council retain the option of eminent domain if they later determine it necessary, while leaving unit counts, setbacks and density unchanged: "So the effect of this is simply to amend the existing plan, to include reference to the right of condemnation…No other conditions of the plan change in terms of the number of units, the size, the setbacks, the density. It's all identical." (Barry)
The council approved a resolution to refer the amended redevelopment ordinance to the Planning Board for statutory review under the New Jersey Municipal Land Use Law.
