Summary
Erin Stuckey told the Fairport Village Board that loud DJ music from the B Side on Lift Bridge Lane reached her home more than 1,200 feet away, disrupted sleep and outdoor enjoyment, and prompted multiple 911 calls. Erin Stuckey of 34 East Avenue told the Fairport Village Board on Aug. 10 that music from the B Side on Lift Bridge Lane repeatedly reached her backyard and bedroom, preventing sleep and outdoor enjoyment on recent Friday and Saturday nights.
"The music from that establishment is reaching my home, which is more than 1,200 feet away... and is of sufficient volume to impact my ability to enjoy reposing at my fire pit as well as, in some cases, preventing sleep from 11:11PM to 2AM in the morning," Stuckey said, adding that she recorded decibel measurements on her phone and called emergency services several times.
Stuckey told the board she could distinguish songs from her house—citing hearing "Smash Mouth by All Star"—and said the volume rose after officers notified the establishment. She urged officials to use stronger penalties in repeated violations of chapter 3-30 of the village code, including application of the second tier of penalties in section 4 or raising the fine from its 1990 level of $250 to an inflation-adjusted amount.
Mayor asked Village Manager White to review Stuckey's complaint with staff and report back to the board on possible enforcement or changes to fines. Board members indicated support for staff follow-up but did not adopt an immediate ordinance change during the meeting.
