The Planning Board on Aug. 10 found that an ANR filing to divide a wetland‑backed lot at 84R Highland Shores Drive does not meet the statutory criteria for approval‑not‑required and instead constitutes a subdivision.
Sam Iameli of JC Engineering presented the plan and said the purpose was to create two parcels so one could be conveyed to an abutter. Board members reviewed the plan and concluded neither of the newly created parcels would have frontage on an "adequate way" as required by state subdivision law for an ANR; the board therefore moved to find the proposal a subdivision requiring formal subdivision control review. The motion passed by voice vote.
The board suggested practical options: redraw lot lines, combine the new lot with an existing parcel that has frontage, or bring a subdivision application. The board also voted to grant the director of planning discretion to waive application technicalities without prejudice so the applicant could refile with a corrected submission.
The applicant was advised to work with planning staff to determine the most efficient path forward; no substantive policy change resulted from the decision.
