Chesapeake Bay Board grants exception for deck at 103 Northpointe Drive

The James City County Chesapeake Bay Board voted Aug. 11 to grant an exception for the construction of a rear deck at 103 Northpointe Drive (CBPA26-0069).
Emily Grojeau, the county watershed planner, told the board the parcel was platted before the county ordinance and that the proposal creates 256 square feet of impact within the landward 100-foot buffer. "This application meets the ordinance conditions in sections 23-11 and 23-14 and should be heard by the board," Grojeau said, and staff recommended approval with mitigation consisting of 0.5 planting unit (six shrubs) and a $500 surety to guarantee the planting plan.
The applicants (Rebecca Croft and Simon Middleton) submitted a letter asking for approval while they are overseas. Board members raised minor erosion-control questions and favored mulch or pea gravel under the deck to limit sheet flow. After discussion, the board adopted the resolution to grant CBPA26-0069 by roll-call vote.
Conditions include obtaining other required permits, filing the required surety, and beginning construction by Aug. 11, 2027 unless an extension request is submitted.
