Planning director briefs UDO text amendment to align local rules with House Bill 926

Chris Murphy, the county planning director, briefed the board on UDOCC-34, a text amendment to chapters 2, 3 and 4 of the Unified Development Ordinance intended to ensure local code complies with North Carolina House Bill 926 (the Regulatory Reform Act of 2025). Murphy said the changes remove waiting-period prohibitions on refiling withdrawn or denied applications, clarify vested-rights language, and modify standards for petitions that span split jurisdictions. "The aforementioned changes are necessary to ensure that our UDO does comply with that statutory language as outlined in House Bill 926," he said.
Murphy told the board the Planning Board heard the item at a March 12, 2026 public hearing and recommended approval unanimously; he said staff and the city and county attorneys reviewed the proposed edits. A commissioner asked whether there had been public notice or an opportunity to discuss the waiting-period prohibition at the time the state enacted the law; Murphy said he could not speak to the state process and was not certain whether the Legislature provided a local notice opportunity prior to enactment. The presentation closed with staff offering to answer further questions at Thursday's meeting where formal action will occur.
