Councilmembers on July 27 voted to defer consideration of a rezoning application submitted by Daniels Construction for a 36-acre tract near Roth Road, citing unresolved wetlands and drainage questions.
Jeff Diamond of Quality Engineering & Surveying told the council the applicant seeks to add 18 single-family lots, townhomes and a one-acre commercial tract as an extension of the Gonzalez Trace subdivision. Council members pressed for due diligence after reviewing maps that showed multiple ponds and apparent wetland areas. Councilwoman Lambert moved to defer the rezoning until “a qualified wetlands delineation, any applicable wetlands mitigation requirements and a drainage and stormwater analysis is done,” and the motion passed.
During the discussion the applicant’s consultant said wetlands delineation and permitting can take months to years: “the delineation is approximately four to six months. The jurisdictional determination usually runs another six months, and then permitting can run anywhere from 12 to 24 months,” noting those studies are typically part of later engineering phases, not the rezoning step. Council emphasized the deferral is intended to identify the developable acreage before any zoning change is returned to the council for action.
